Court overturns EFCC boss Bawa's conviction

 

 

The contempt proceedings and all of the orders of conviction for contempt against Abdulrasheed Bawa, the Chairman of the Economic and Financial Crimes Commission, were dismissed by the High Court of the Federal Capital Territory in Abuja on Thursday.

 

After hearing a request made by Bawa, Justice Chizoba Oji today halted the proceedings.

 

The Federal Republic of Nigeria 1999 Constitution (as amended), Sections 6(6)(a) and 36(1), Section 91 of the Sheriffs and Civil Process Act, Cap. S6 Laws of the Federal Republic of Nigeria 2004 and other pertinent laws were cited in support of the application.

The court ruled that Bawa was not in contempt of court at the time of the order because he cooperated with the directive to release the respondent’s Range Rover and because the applicant started the EFCC’s internal process for paying the respondent N40,000,000 through a series of internal memos.

Recall that Bawa was sentenced to prison, at Kuje Correctional Facilities earlier this week for contempt of court pending the setting aside of the order.

 

The EFCC Chairman was found to have disobeyed a November 21, 2018, order by Justice Oji.

 

The Range Rover and N40 million and other seized property were to be returned per the court’s order.
